NantHealth believes that the confidentiality of personal and sensitive information is one of its fundamental responsibilities. We are committed to compliance with all applicable country-specific data privacy laws, including but not limited to, the EU General Data Protection Regulation (GDPR). Protecting the privacy and security of your Personal Data is of the highest importance to us. This Privacy Policy describes the online policies and practices adopted by NantHealth to ensure the protection of your personal data and to respect your fundamental right to privacy.
Personal Data is defined as information that can directly or indirectly be associated with a specific individual or entity, including, for example, a name, address, or telephone number, e-mail address, IP address, and information about online activities that are directly linked to them.

User Requests and Corrections of User Information: NantHealth honors requests from users for their own information and will correct any such information which may be inaccurate. Users may verify that appropriate corrections have been made.
Internet Protocol Addresses: When you access our Site, our system logs your Internet Protocol address to provide general information about your location, your connection to the Internet and your Internet service provider. Unless permitted by applicable law, this information will not be used by NantHealth to identify you.
Cookies: The Site may use “cookies” for the purpose of facilitating the gathering of non-specific user information. A cookie is a very small text file stored on a web site user’s hard disk that allows a web server to recall certain information that the user has already entered previously. If you wish not to utilize cookie technology, this feature may be disabled within your web browser.
Clear Gifs (Web Beacons, Web Bugs): We may employ a software technology called clear gifs (also known as Web beacons or Web bugs) along with similar technologies to help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies that are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs, which are about the size of a period, are embedded invisibly on Web pages. We do not tie the information gathered by clear gifs, e-tags, or java scripts to our customers’ Personal Data.
Personal Health Information: NantHealth respects and will at all times attempt to protect personal health information. This website is not intended for the purpose of collecting, protecting or analyzing personal health information nor of providing any health care advice or instructions. Please do not email NantHealth any personal health information as that is not a secure form of communication. NantHealth will delete any personal health information inadvertently provided on the Site.
Other Web Sites: NantHealth’s privacy policy only applies to the Site. The Site may link from several points throughout the Site to third-party websites and information or service providers that may collect personal information from you in order to provide you with information or services. Advertisements that may appear on pages on the Site may also request Personal Data or provide you with access to other sites that request Personal Data. NantHealth has no control over the privacy policy of any third party or other website. Their privacy policies may differ or they may have no privacy policies. Please examine the privacy policies of such third parties prior to submitting any personal information, as they may differ from ours.
Surveys: NantHealth may from time to time conduct surveys on the Site. Surveys are conducted at random and are completely voluntary to users of the Site. The survey may require a user, who voluntarily participates, to provide Personal Data. NantHealth may use this information and share it with its contractors as described above to better tailor its products, services and marketing efforts, including advertising or other content provided on the Site and/or to you in particular.
Additional Privacy Protections for Children Using the Internet: NantHealth does not solicit or target persons younger than legal age for collection of information online. Our Site does not permit children under the age of 13 to become users and we do not accept any information from children. By submitting information via the Site you represent that you are over the age of 13. NantHealth encourages minors to seek the consent of their parents before providing any information about themselves or their households to anyone on the Internet. Business Transfers: In the event that NantHealth or any of its affiliates is acquired by (whether by sale of assets or ownership interests), merged with, or divested to a third-party entity, we may transfer or assign the information we have collected from our website visitors as part of such merger, acquisition, sale, divestiture, or other change of control. This Privacy Policy (this “Policy”) covers the information practices of websites that link to this Policy (each referred to as a “Site”). NantStudios, LLC (“NantStudios”) believes in protecting your privacy and the confidentiality of your Personal Information (as defined below).
As used in this Policy, the term: (a) “Affiliate” means, as to any person or entity, any other person or entity that, directly or indirectly, is in Control of, is Controlled by or is under common Control with such person or entity; (b) “Control” means the possession, directly or indirectly, of the power to direct or cause the direction of the management, policies or activities of the person or entity in question, whether through ownership of voting securities, by contract or otherwise; (c) “NantStudios Parties” means NantStudios and/or one or more of its Affiliates (each, individually, a “NantStudios Party”); and (d) “Personal Information” means any combination of information, in the possession of or likely to come into the possession of a NantStudios Party that relates to a discrete individual. For purposes of clarification, any information which cannot be related to a discrete individual (such as aggregated statistical information) is not Personal Information.
References to “we,” “our,” or “us” in this Policy shall mean the NantStudios Parties.
PURPOSE FOR COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION
The NantStudios Parties collect, use and disclose your Personal Information in its normal course of business for the following purposes:
- Establishing and maintaining communications with you;
- Where you have requested information from any of the NantStudios Parties, assisting you in the completion of your request and the assessment of your eligibility for any such request;
- Responding to your inquiries about the NantStudios Parties’ products, services, or employment with NantStudios;
- Allowing the NantStudios Parties to notify you of certain products or services offered by one or more NantStudios Parties;
- Allowing the NantStudios Parties to notify you of certain employment opportunities provided by one or more NantStudios Parties;

INFORMATION WE COLLECT/GENERATE

Information voluntarily provided by you
When using the Site or doing business with a NantStudios Party, you may choose to provide a NantStudios Party with information to help one or more NantStudios Parties serve your needs. The Personal Information that we collect will depend on how you choose to use the Site and what Personal Information you share with a NantStudios Party outside of the Site.
- Where you request information from a NantStudios Party
If you request information from a NantStudios Party, we require you to submit your name, e-mail address, the name of your organization, and any other necessary contact information so we may send you the material you have requested, and to enable us to identify if you are an existing customer or employee of a NantStudios Party.
- Where you register with a NantStudios Party and/or request services
If you register with a Site, or request a service available on a Site, we may ask you for your name, e-mail address, country, telephone number and the reason for your communication, and other information as is reasonably necessary so that we can provide you with the requested information or service. On the data submission form, we will indicate by way of an asterisk, which information is optional and which information is mandatory. This information can include:
- Information you provide on applications or other forms, which may include your name, address, email address, or employment history;
- Information we acquire from and/or transfer to other persons (such as government agencies, your bank, or your employer) to verify your identity and the accuracy of the information you have provided and for other related purposes; and
- Information about you received from a NantStudios Party, another intermediary, third party providers, and others which are necessary for the provision of our services or consideration of you for employment.
Any Personal Information that you send us will be used for the purpose indicated on the applicable Site or in this Policy.
Website Navigational Information
As you navigate a Site, we may also collect information through the use of commonly-used information-gathering tools, such as cookies and web beacons (collectively “Website Navigational Information”). Website Navigational Information includes standard information from your web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on a Site (such as the web pages viewed and the links clicked).

The Site uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help websites analyze how users use the site. The information generated by the cookie about your use of a Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. The major browsers have attempted to implement the draft “Do Not Track” (“DNT”) standard of the World Wide Web Consortium (“W3C”) in their latest releases. As this standard has not been finalized, the Site is not compatible with DNT.

Functionality
These cookies allow our Site to remember choices you make (such as your user name, language or the region you are in) and provide enhanced features. - IP Addresses
When you visit our Site, we collect your Internet Protocol (“IP”) addresses to track and aggregate non-Personal Information. For example, we use IP addresses to monitor the regions from which users navigate the Site. IP addresses will be stored in such a way so that you cannot be identified from the IP address.
DISCLOSURE OF INFORMATION TO OTHERS
We do not disclose any Personal Information about you to third parties except as stated in this Privacy Policy, as otherwise permitted by law, or authorized by you.
Third parties to whom we generally disclose information are required by law, or a contract with us, to keep your Personal Information confidential and secure, and to use and disclose it for purposes that a reasonable person would consider appropriate in the circumstances and generally for purposes as follows:

- To notify you or allow NantStudios Parties to notify you of certain products or services offered by NantStudios Parties;

Affiliate Sharing
In the normal course of performing services for our clients, Personal Information may be shared among NantStudios Parties for research and statistical purposes, system administration, joint marketing, providing you services or information, and crime prevention or detection.
Service Providers
Because a number of the service providers we use are located in the United States, your Personal Information may be processed and stored inside the United States, and the U.S. government, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your Personal Information under US laws.
In addition, generally, we will only provide your Personal Information to our lawyers, accountants, tax consultants and employees for the purpose of conducting our business and providing you with information. Our service suppliers adhere to the same protections regarding the collection, use, and retention of data as we do.
Business Transactions
As we continue to develop our business, we might sell or buy assets. In such transactions, user information, including Personal Information, generally is one of the transferred business assets. For example, we use IP addresses to monitor the regions from which users navigate the Site. IP addresses will be stored in such a way so that you cannot be identified from the IP address.
DISCLOSURE OF INFORMATION TO OTHERS
We do not disclose any Personal Information about you to third parties except as stated in this Privacy Policy, as otherwise permitted by law, or authorized by you.

Affiliate Sharing
In the normal course of performing services for our clients, Personal Information may be shared among NantGames Parties for research and statistical purposes, system administration, joint marketing, providing you services or information, and crime prevention or detection.

Because a number of the service providers we use are located in the United States, your Personal Information may be processed and stored inside the United States, and the U.S. government, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your Personal Information under US laws.
In addition, generally, we will only provide your Personal Information to our lawyers, accountants, tax consultants and employees for the purpose of conducting our business and providing you with information. Our service suppliers adhere to the same protections regarding the collection, use, and retention of data as we do.
Business Transactions
As we continue to develop our business, we might sell or buy assets. In such transactions, user information, including Personal Information, generally is one of the transferred business assets. Also, if a NantGames Party itself or substantially all of a NantGames Party’s assets were acquired, your Personal Information may be one of the transferred assets. Therefore, we may disclose and/or transfer your Personal Information to a third party purchaser in these circumstances.
Other Legally Required Disclosures
The NantGames Parties reserve the right to disclose, without your prior permission, any Personal Information about you or your use of a Site if the NantGames Party has a good faith belief that such action is necessary to: (a) protect and defend the rights, property or safety of a NantGames Party, a NantGames Party’s employees, other users of a Site, or the public; (b) enforce the terms and conditions that apply to use of a Site; (c) as required by a legally valid request from a competent governmental authority; or (d) respond to claims that any content violates the rights of third-parties. We may also disclose Personal Information as we deem necessary to satisfy any applicable law, regulation, legal process, or governmental request.

Fundamentally, if we have a permissible need to retain Personal Information, we are not under an obligation to delete such information, even when requested. Right to Opt-Out. We do not sell or share your Personal Information to unaffiliated third parties for their marketing purposes. As such, there is no need for you to opt-out of the sale of information to such parties.
Designating an Authorized Agent. Some state law permits residents of that state to designate an agent to manage their rights under state law. If you would like to designate an agent to manage your privacy preferences, you may do so using the mechanisms noted below under “Exercising State Privacy Rights.” Note that if you do not have an account with us, we may ask for some Personal Information in order to verify your identity and your rights to the data subject to your request. SAFEGUARDS
We have in place reasonable safeguards appropriate to the sensitivity of the information we maintain. Safeguards will vary depending on the sensitivity, format, location, amount, distribution and storage of the Personal Information. They include physical, technical and managerial measures to keep Personal Information protected from unauthorized access. If there is any material change to your rights under this Policy, NantGames will provide you with notice of such change 30 calendar days prior to the changes going into effect. 1. What Information of Yours Do We Hold and Who Do We Collect It from?
Information Submitted by You:
- Identity data means your personal information you give to us when you apply for our products or services, or enter a Mox competition or game, e.g. your name, date of birth, identity card number, correspondence address, phone number, email address, nationality, credit-related information or even other data such as selfies.
- Communications data includes how you want us to contact you and your preferences for the marketing we send you.
Information We Collect about You and Your Device:
- Financial data includes your Mox Card number, transactions conducted through your Mox Account, Mox Invest Account or any of your Goal accounts and any data on other Mox products and services you use.
- Technical data means details such as your mobile network, operating system, IP address, and the settings and technology on your mobile phone.
- Usage data includes information about how you use our website, the Mox app and products and services.
Information from You (or Created by You) Which You May Give Us Permission to See, for the Purposes of Providing Products or Services to You:
- Your contacts list, to facilitate payments and transactions between you and your contacts.
- Your geolocation, to help you onboard as a Mox customer and for other security and compliance checks while using our products and services.
- Your facial image data from your camera, to help you onboard as a Mox customer and so that we can confirm your identity.
- Information that you may provide to us, including information that you may post on our website and social network sites, to enable us to communicate with you and to provide products and services to you.
Information from Third Parties Which Helps Us Deliver Our Products and Services:
- General due diligence includes data that the law requires us to process about you in relation to illegal activities involving money.
- Financial due diligence includes data we receive from credit reference agencies to help with responsible lending decisions.
Sometimes we will aggregate information. This means we will combine information from groups of customers to create a profile group for research, analysis or to help with general marketing. Aggregated data will not show your identity, but if we end up connecting this to you personally, then we will protect that data in the way stated in this Privacy Policy Statement.
2. How Do We Protect Your Data?
Some of the security measures we use to protect your data include:
- Firewalls – like a security guard whose job it is to decide who can access a building, firewalls proactively block certain information flows to our app by screening the flows based on a set of rules that Mox will set.
- Intrusion detection systems (“IDS”) – like a security camera, IDS monitor information flows for patterns of activity that don’t look normal and might signal an attack on our app.
- 24/7 physical protection of facilities where your data is stored.
- Background checks on people that need access to those physical facilities to do their job.
We also use digital signatures and encryption. Encryption changes your data into a code that can only be read by Mox and some of our trusted partners who need access to it. We always encrypt your data using the highest standards of security technology.
Encryption helps to ensure:
- we can confirm the identity of the user;
- we can prove that a transaction took place on the instruction of a specific person;
- we can make sure that personal data is kept private by keeping the information hidden; and
- we can ensure that the personal data was not changed during transfer or storage by someone without authority.

3. Automated Decisions and Profiling
We may use algorithms when considering and processing your application for Mox products and services. The algorithms provide automatic assessments and decisions based on the personal data collected in accordance with our PICS. The parameters used in these assessments have been selected to provide a fair and objective assessment of your personal data and have been tested for reliability and fairness. If we are uncertain about the accuracy of the personal data that will be used in an algorithmic assessment, we may ask you to clarify any such personal data.
